Welcome to Skyvera ("we," "us," "our," or "the Platform"). Skyvera is an online travel marketplace that enables customers to search, compare, and book flights, hotels, private jets, luxury cars, cruises, and visa services. By accessing our website or booking through our Platform, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

Service-Specific Terms

These Terms include service-specific sections. Please review the section applicable to your booking:

1. Definitions

  • "Booking" means a reservation made through the Platform for any travel-related service.
  • "Customer" or "You" means the person making a booking through the Platform.
  • "Service Provider" means the airline, hotel, charter operator, car rental company, cruise line, or visa processing agency fulfilling your booking.
  • "Booking Reference" means the unique alphanumeric code issued to you upon successful booking.
  • "Fare Rules" means the specific terms set by the service provider governing a particular booking, including change and cancellation conditions.

2. Acceptance of Terms

By creating an account, searching for services, or completing a booking on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Cancellation Policy, and Refund Policy. These Terms constitute a legally binding agreement between you and Skyvera.

3. Eligibility

You must be at least 18 years of age to make a booking on the Platform. By booking, you represent and warrant that you are at least 18 years old, that all information you provide is accurate and complete, and that you have the legal authority to make the booking on behalf of all passengers/guests listed.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

5. General Booking Terms

5.1. Skyvera acts as an intermediary between you and the service provider. We do not operate the services ourselves. All services are operated by licensed providers and are subject to their own terms, conditions, and operating policies.

5.2. When you make a booking, a reservation is held temporarily (typically 30 minutes) to allow you to complete payment. If payment is not received within this period, the reservation will be automatically released.

5.3. All bookings are subject to availability and confirmation by the service provider. We reserve the right to cancel or refuse any booking at our discretion.

5.4. You must provide accurate information for all bookings, including full names as they appear on travel documents. Incorrect information may result in denied service, and we are not liable for losses arising from inaccurate information provided by you.

6. Pricing and Payment

6.1. All prices displayed on the Platform are subject to change without notice until a booking is confirmed. Prices include base fare/rate, applicable taxes, and fees where indicated.

6.2. We support multiple payment methods including bank transfer, credit/debit card, Cash App, Venmo, and selected cryptocurrencies. Available methods may vary by region and currency.

6.3. Payment must be received in full before a booking is confirmed. Bookings for which payment is not completed within the reservation period will be automatically cancelled.

6.4. All transactions are processed in the currency displayed at checkout. Currency conversion, if applicable, is handled by your payment provider and may incur additional fees.

7. Changes and Modifications

7.1. Changes to an existing booking are subject to the service provider's fare rules and may incur change fees, fare differences, and service charges.

7.2. To request a change, contact our support team with your booking reference. We will process the request with the service provider, but we cannot guarantee that changes will be accepted.

8. Cancellations and Refunds

Cancellations and refunds are governed by our Cancellation Policy and Refund Policy, which form an integral part of these Terms. Service-specific cancellation terms are detailed in the sections below and in the Cancellation Policy.

9. Limitation of Liability

9.1. Skyvera acts solely as a booking intermediary. We are not a party to the contract between you and the service provider.

9.2. To the maximum extent permitted by law, Skyvera shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any booking made through it.

9.3. Our total liability for any claim arising from a booking shall not exceed the service fee charged by Skyvera for that booking.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Make fraudulent, speculative, or false bookings
  • Attempt to gain unauthorized access to any part of the Platform
  • Use automated systems to scrape, collect, or copy content without permission
  • Interfere with the proper functioning of the Platform
  • Provide false, inaccurate, or misleading information

11. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Skyvera or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

12. Third-Party Links

The Platform may contain links to third-party websites and services. We are not responsible for the content, policies, or practices of any third-party sites and are not liable for any damages arising from your use of them.

13. Governing Law and Dispute Resolution

13.1. These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

13.2. Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, the dispute shall be submitted to binding arbitration.

13.3. You agree that any claim must be brought within one (1) year from the date the cause of action arose.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Service-Specific Terms: Flights

The following terms apply specifically to flight bookings made through the Platform.

F1. Airline Conditions

F1.1. Each fare is governed by the airline's fare rules, which may restrict changes, cancellations, refunds, and baggage allowances. Fare rules are displayed during the booking process.

F1.2. Skyvera has no control over airline fare rules and is not responsible for any restrictions imposed by the airline, including non-refundable fares, change fees, or seating policies.

F2. Travel Documents

F2.1. It is your responsibility to ensure that you and all passengers have valid travel documents, including passports, visas, and any required health documentation for your destination.

F2.2. Skyvera is not liable for denied boarding, entry refusal, or any losses arising from invalid or missing travel documents.

F3. Special Requests

Special requests including meal preferences, seat selection, wheelchair assistance, and other accessibility needs are forwarded to the airline but are not guaranteed until confirmed by the carrier.

F4. Flight Disruptions

F4.1. Flight schedules are subject to change by the airline. Skyvera is not responsible for flight delays, cancellations, schedule changes, or any disruptions caused by the airline, weather, air traffic control, or other factors beyond our control.

F4.2. In the event of a flight disruption, you should contact the airline directly for assistance. We will provide reasonable support but are not liable for any resulting losses.

Service-Specific Terms: Hotels

The following terms apply specifically to hotel bookings made through the Platform.

H1. Reservations and Room Types

H1.1. Hotel reservations are subject to availability and confirmation by the hotel. Room types, bedding configurations, and views may vary from images shown on the Platform.

H1.2. Check-in and check-out times are set by the hotel. Early check-in or late check-out may incur additional fees and are subject to availability.

H2. Guest Information

H2.1. You must provide accurate guest names matching the travel documents. The lead guest must be at least 18 years old and must present a valid photo ID at check-in.

H2.2. Maximum occupancy per room is determined by the hotel. Additional guests may incur extra charges or may not be accommodated.

H3. Hotel Policies

H3.1. Each hotel has its own policies regarding pets, smoking, parties, noise, and guest conduct. You are responsible for complying with all hotel policies.

H3.2. Damage to hotel property may result in charges to your payment method. Skyvera is not responsible for damages caused by guests.

H4. Room Rates and Taxes

H4.1. Room rates are quoted per night and may vary by date and occupancy. Rates typically include applicable hotel taxes, but local tourist taxes or resort fees may be charged directly by the hotel at check-in or check-out.

H4.2. Skyvera charges service and booking fees as displayed during checkout. These fees are separate from hotel-imposed charges.

Service-Specific Terms: Private Jets

The following terms apply specifically to private jet charter bookings made through the Platform.

P1. Charter Bookings

P1.1. Private jet charter bookings are for the exclusive use of the aircraft for the agreed flight route and time. The charter price is calculated based on the estimated flight hours, determined by the great-circle distance between airports and the aircraft's hourly rate.

P1.2. Flight time estimates include taxi, takeoff, and landing time. Actual flight time may vary due to weather, routing, air traffic control, and fuel stop requirements.

P1.3. If the actual flight time exceeds the estimate (e.g., due to weather rerouting or additional stops requested by the customer), additional charges will apply at the aircraft's hourly rate.

P2. Passenger Requirements

P2.1. All passengers must provide valid government-issued photo identification matching the names provided at booking. Passengers without valid ID will be denied boarding.

P2.2. Passenger counts must not exceed the aircraft's certified capacity. Weight and balance restrictions may further limit the number of passengers or amount of luggage.

P3. Aircraft Availability

P3.1. Aircraft are subject to availability and operational status. If the booked aircraft becomes unavailable due to maintenance, mechanical issues, or other operational reasons, Skyvera will offer a comparable alternative aircraft or a full refund.

P3.2. Skyvera reserves the right to substitute an equivalent or superior aircraft at no additional cost.

P4. Airport and Handling Fees

P4.1. Landing fees, handling fees, parking fees, and crew expenses may or may not be included in the charter price, depending on the aircraft and route. Any additional fees will be communicated before or at the time of booking.

P4.2. International flights may require customs, immigration, and overflight permit fees that are not included in the base charter price.

P5. Catering and Ground Transport

P5.1. Standard catering is typically included. Special catering requests may incur additional charges.

P5.2. Ground transportation to and from the airport is not included unless explicitly stated at booking.

Service-Specific Terms: Luxury Cars

The following terms apply specifically to luxury car rentals made through the Platform.

L1. Rental Requirements

L1.1. The primary driver must be at least 25 years old (some vehicles may require a higher minimum age) and must present a valid driver's license held for a minimum of 3 years.

L1.2. A valid credit card in the primary driver's name is required for the security deposit at the time of pickup.

L2. Insurance and Damage

L2.1. Basic insurance is typically included. Additional coverage options (CDW, SCDW, personal accident insurance) may be purchased at pickup.

L2.2. The renter is responsible for any damage to the vehicle during the rental period. A security deposit will be held and may be applied to cover damages.

L3. Mileage and Fuel

L3.1. Mileage allowances vary by vehicle and rental package. Additional mileage beyond the included allowance will be charged at the per-mile/km rate specified at booking.

L3.2. The vehicle must be returned with the same fuel level as at pickup. Refueling charges will apply if the fuel level is lower.

L4. Vehicle Availability

L4.1. Specific vehicle models are subject to availability. The rental company may substitute a comparable or superior vehicle at no additional charge.

Service-Specific Terms: Cruises

The following terms apply specifically to cruise bookings made through the Platform.

C1. Cabin Bookings

C1.1. Cruise cabin categories are subject to availability. Cabin numbers are typically assigned by the cruise line and may not be guaranteed until boarding.

C1.2. Cabin images and descriptions are provided by the cruise line and may differ from the actual cabin.

C2. Itinerary Changes

C2.1. Cruise itineraries are subject to change by the cruise line due to weather, port availability, mechanical issues, or other operational reasons. Skyvera is not responsible for itinerary changes.

C2.2. Port arrivals and departures may be delayed or skipped at the cruise line's discretion. Refunds for missed ports are determined by the cruise line's policy.

C3. Onboard Charges

C3.1. Cruise fares typically include accommodation, meals in main dining venues, and most entertainment. Specialty dining, beverages, excursions, spa services, and other onboard purchases are charged separately.

C3.2. Gratuities/service charges may be automatically added to your onboard account. Check the cruise line's policy for details.

C4. Travel Documents for Cruises

C4.1. All passengers must have valid passports and any required visas for all countries on the itinerary. Some cruises may require additional documentation.

Service-Specific Terms: Visa Services

The following terms apply specifically to visa application assistance services booked through the Platform.

V1. Service Scope

V1.1. Skyvera provides visa application assistance, including document review, form preparation, and submission support. We do not guarantee visa approval, as the decision rests solely with the relevant embassy or consulate.

V1.2. Visa processing times are estimates and may vary based on embassy workload, application complexity, and individual circumstances.

V2. Applicant Responsibilities

V2.1. You are responsible for providing accurate, complete, and truthful information and documentation. False or incomplete information may result in visa denial and may affect future applications.

V2.2. You must attend any required in-person appointments (interviews, biometrics) at the embassy or consulate.

V3. Government Fees

V3.1. Government/embassy visa fees are separate from Skyvera's service fees. Government fees are non-refundable once submitted to the embassy, regardless of the visa decision.

V4. Visa Denial

V4.1. If a visa application is denied, Skyvera's service fees are non-refundable, as the service (document preparation and submission) has been rendered. Government fees are also non-refundable.

V4.2. Skyvera may offer assistance with re-application at a discounted service fee, subject to the circumstances of the denial.
